Consumer Protection

Consumer protection involves using the law to protect consumers in Florida and across the country from injustice and harm in a number of different situations, such as:

  • Protection from unscrupulous car salesman with the use of lemon laws;
  • Protection from abusive and terrifying debt collectors with the application of fair debt collection practices statutes;
  • Protection from unfair credit reporting via accuracy in credit laws;
  • Protection from improper car repossessions by using laws such as federal privacy statutes and Florida property repossession laws; and
  • Protection from unwarranted home foreclosures by using federal laws and Florida foreclosure protection law.

Extensive Legal Protection Exists for the Consumer under Both State and Federal Law

Over the years, lots of legislation has been passed to protect consumers from the unethical and bad acts of wrongdoers, particularly those dealing with credit and the reclaiming of property (cars, homes).  A few examples of federal laws that protect consumers include:

In the State of Florida, there are also a wide variety of laws in place to help consumers who have been wronged, like lemon laws and fair banking regulations.  However, the major statute for consumer protection under Florida law remains the Deceptive Trade Practices Act, which protects against a wide variety of illegal conduct.

The Attorney General for the State of Florida investigates and files suit based upon the DTPA against persons who engage in unfair methods of competition, unfair, unconscionable or deceptive trade practices, including, but not limited to, pyramid schemes, misleading franchise or business opportunities, travel scams, fraudulent telemarketing, and false or misleading advertising.  Private lawsuits can also be filed based upon violations of this statute.

Hiring a Consumer Protection Attorney Can Bring You Justice and Peace of Mind

Bullying bill collectors, shady car salesman, and midnight repo men do not just violate the law, they also destroy the peace and security of the family home.  Having an experienced consumer protection lawyer on your side, to protect and fight for your rights, can lift a huge burden emotionally as well as assisting in obtaining justice.
