Media Law

Telecommunications law involves the regulation of communications in this country by not only the federal government, through such agencies as the Federal Communications Commission (“FCC”), but a variety of state and local agencies and commissions, as well.  Telecommunications lawyers represent the rights of the public at large, as well as private companies including broadcasting and cable television companies as well as communication carriers (e.g., telephone companies) and private communication systems (such as internet service providers) in areas of licensure, public or private securities offerings, and their sale or purchase -- including possible antitrust or business litigation that may coincide with these efforts.

As a telecommunications attorney, J.B. Harris has achieved national recognition in his successful fight regarding the proposed sale of NBC-6 in Miami.  Representing the Coalition of Concerned Citizens for Competition and Fairness in Broadcast Journalism, J.B. Harris fought against the application by NBC Telemundo with the Federal Communications Commission to transfer the broadcasting license of WTVJ-TV (“NBC 6”) to Post-Newsweek Stations, a licensee of WPLG-TV (Channel 10 in Miami).   Through his efforts, J.B. Harris was able to protect and save the jobs of over  250 employees of NBC-6.

Media Law and First Ammendment Rights

During his years of representing plaintiffs in aviation and tobacco litigation, among other things, J.B. Harris has also researched aspects of media law and investigated the growing attacks upon First Amendment rights as they impact privacy, libel, slander, defamation, and related legal areas.

It is the position of J.B. Harris that the freedom of speech as well as a freely competitive media and communications industry is vital to Florida, as well as the United States as a whole.  Accordingly, J.B. Harris, P.A. is dedicated to representing plaintiffs in the pursuit of their rights under current media law, such as:

The Right to Access Government Information

J.B. Harris understands that while both federal and state law allows access to government information, the reality is that it sometimes takes legal intervention to gain access to that information.    This includes legal intervention in order to gain access to closed meetings, to public records, and to closed-door judicial proceedings.

Whether it entails filing a Freedom of Information Act lawsuit in either federal or state court or insuring that government agencies and private entities are operating in the sunshine and within the provisions of the Open Meetings statutes, J.B. Harris is aggressively committed to fighting for a plaintiff’s right to know.

Law of the Internet

E-commerce and internet copyright and trademark issues seems to overlap areas of traditional media law, such as defamation and privacy, and J.B. Harris represents clients with a variety of world wide web legal concerns.  These include protecting registered domain names; pursuing privacy and defamation (libel, slander) claims based upon internet activity.
